1. Acceptance of Terms

By using FollowDesk, you agree to these Terms of Service. FollowDesk is operated by Framewrk LLC. If you do not agree, do not use the service.

2. Description of Service

FollowDesk is an AI-powered SMS follow-up automation platform for real estate agents, MedSpa owners, insurance professionals, mortgage advisors, and other service businesses. The platform enables agents to send automated SMS nurture sequences to leads who have opted in to receive communications.

3. SMS Messaging Terms

Authorized Use Only: FollowDesk may only be used to send SMS messages to leads who have explicitly consented to receive communications from the agent or business using the platform.

Message Frequency: Message frequency varies based on your configured sequences. Standard message and data rates apply to end users. Users acknowledge that "Msg & data rates may apply" to their wireless service plan.

Opt-Out Compliance: Users may opt out at any time by replying STOP to any message. FollowDesk automatically processes opt-outs, and no further messages will be sent. You must honor all STOP requests immediately.

Help Requests: Users may reply HELP to receive additional information. FollowDesk will provide support information in response to HELP requests.

Prohibited Content: You may not use FollowDesk to send spam, unsolicited messages, illegal content, or messages that violate TCPA, CAN-SPAM, or any applicable laws.

Opt-In Requirements: You are responsible for obtaining proper written or documented consent from all leads before adding them to FollowDesk sequences. Consent must be obtained via signed agreement, web form with explicit SMS opt-in checkbox, or verbal consent that is documented.

4. User Responsibilities

• You are responsible for compliance with all applicable laws including TCPA and state regulations
• You must maintain records of consent for all contacts in your account
• You may not use FollowDesk for any illegal or unauthorized purpose
• You are responsible for the content of messages sent through your account
• You must keep your account credentials secure

5. Prohibited Uses

• Sending messages to individuals who have not provided consent
• Sending messages that are deceptive, misleading, or fraudulent
• Using FollowDesk for any purpose other than legitimate business follow-up
• Attempting to circumvent opt-out requests
• Violating any applicable federal, state, or local laws

6. Payment Terms

FollowDesk subscription fees are billed monthly. You may cancel at any time. Refunds are not provided for partial billing periods. Prices are subject to change with 30 days notice.

7. Termination

We reserve the right to terminate accounts that violate these terms, engage in spam, or fail to comply with applicable laws. You may terminate your account at any time.

8. Limitation of Liability

FollowDesk is provided "as is." Framewrk LLC is not liable for damages arising from your use of the service, including any TCPA violations resulting from your failure to obtain proper consent.

9. Changes to Terms

We may update these terms at any time. Continued use of FollowDesk after changes constitutes acceptance of the new terms.
